Terms of Service

These terms apply to website subscription services provided by ApexWeb Studios ("ApexWeb," "we," "us") to the business that signs up ("you," "Client"). Your signed service agreement, if any, controls where it differs from these terms.

1. Services

Depending on your plan (Standard or Growth), ApexWeb provides a custom-designed website, domain management, hosting, SSL, security updates, backups, unlimited small edits, and basic local SEO setup, as described on our pricing page.

2. Term and billing

Subscriptions start with a 12-month initial term, billed monthly in advance by card or bank transfer through our payment processor. After the initial term, your plan renews month to month at the same price unless either party cancels. We may change prices for month-to-month plans with 30 days' written notice.

3. Edit requests

Small edits, such as text changes, photo swaps, price and hours updates, or a new content section, are included without limit and are typically completed within 48 hours (24 hours on Growth) on business days. Larger work, such as a full redesign, new features, or e-commerce, is quoted separately and starts only after you approve the quote.

4. Ownership

You own your domain name, logos, trademarks, and all content you provide, including text and photos. ApexWeb owns the website design, code, and templates, and licenses them to you for as long as your subscription is active and paid. After the initial 12-month term, you may buy out the full website for a one-time fee of $997, after which we transfer the site files to you.

5. Cancellation

After the initial term, either party may cancel with 30 days' written notice. If you cancel during the initial term, the remaining monthly payments for that term become due. On cancellation, we will help you transfer your domain to you and return your content. The website itself stays with ApexWeb unless you buy it out.

6. Late or failed payments

If a payment fails and is not resolved within 14 days of notice, we may suspend your website until the account is brought current.

7. Your responsibilities

You confirm that you have the rights to all content you send us and that your website content is accurate and lawful. You are responsible for your business's licenses, pricing, and claims shown on your site.

8. Uptime and liability

We work to keep your site online and secure, but we do not guarantee uninterrupted service. To the fullest extent the law allows, ApexWeb's total liability for any claim is limited to the fees you paid in the three months before the claim, and we are not liable for lost profits or indirect damages.

9. Governing law

These terms are governed by the laws of the Republic of Kosovo, without regard to conflict-of-law rules.
